Commissioners for taking affidavits (sometimes referred to as commissioners of oaths) take affidavits or declarations by asking you to swear or affirm that what is in a document is true. In Ontario, they’re regulated under the Commissioners for taking Affidavits Act.
A notary public has all the powers of a commissioner for taking affidavits and, can verify that signatures, marks and copies of documents are true or genuine. Notaries are regulated under the Notaries Act.
At Nachla Law Office, we have a notary public and/or a commissioner of oaths on-site at our main office location in Oakville during regular business hours. To avoid disappointment/ inconvenience, we recommend that you call our office before attending in order to make sure the right person is available and on-hand to commission/notarize your document as necessary.
There are two types of documents that require a notary or commissioner of oaths:
1. You require your oath to be taken on a document. Here you swear or affirm that the contents of the document are true. Examples include affidavits and statutory declarations. Usually, you will prepare these documents in full before you come into our office. We do not provide legal advice regarding the document(s) or their contents. We simply take your oath or affirmation. Please remember to bring photo identification with you. The purpose of the notary/commission is to authenticate your identity and signature.
2. You require a certified true copy of an original document. You must bring your original document to our office so that we may certify a true copy of it.
